Returns and Art Preservation Policy

1. Final Sale Framework & Archival Integrity

At Phire Gigno Limited ("PhiréGigno," "the company", "we", "us"), we handle each artwork with the utmost care. All sales of physical original paintings are considered final from the exact moment payment is processed.

Due to the unique, singular nature of original works and their strict museum-grade archival preparations, we do not accept returns, cancellations, or exchanges for change of mind. Orders cannot be cancelled during processing, transit, or after delivery, and no items can be reintroduced into our inventory.

Collectors are highly encouraged to thoroughly review all dimensions, materials, and presentation specifications prior to acquisition.

2. Custom, Commissioned, and Bespoke Works

All custom orders, site-specific commissions, and bespoke works are strictly non-refundable and final sale from the moment the initial deposit or payment is processed.

  • Artistic Interpretation: Because bespoke works rely on artistic interpretation, claims of "material difference" or aesthetic dissatisfaction are explicitly excluded from remedies.

  • Approval Process: Final approval of a commissioned work occurs prior to dispatch (via digital proof or studio viewing). Once approved and dispatched, no claims, returns, or adjustments will be entertained.

  • Cancellation & Forfeiture: If a collector elects to cancel a commission or states they no longer want the work prior to dispatch, all funds paid up to that date are strictly non-refundable and forfeited to the studio to cover specialised archival materials, studio time, and administrative overhead. Phire Gigno Limited is under no obligation to deliver the unfinished or any rejected work if a cancellation is initiated by the buyer.

3. Limited Exceptions: Damage or Misrepresentation

A remedy or return authorisation for artworks may be considered exclusively in rare instances where:

  • The artwork arrives physically damaged due to transit.

  • The artwork delivered is a completely incorrect item, or possesses a physical dimensional discrepancy exceeding 7% of the stated catalogue specifications.

Note: Styled, contextual, or lifestyle marketing images do not constitute grounds for a misrepresentation claim. Please endeavour to thoroughly review all dimensions, materials, and specifications prior to acquisition.

4. Rigid Claim Requirements & Evidence

Please inspect your shipment immediately upon delivery. To initiate a transit damage or misrepresentation claim, you must contact studio@phiregigno.com within 72 hours of confirmed delivery with the following evidence:

  • Proof of Purchase: Your original invoice number, order confirmation email, or digital receipt issued by Phire Gigno Limited.

  • Unboxing Video: Clear, continuous, high-resolution video of the unboxing process (mandatory if external packaging damage is suspected).

  • Photographs: High-resolution photos of the external crate/packaging, the internal protective buffers, and the affected artwork area.

  • Packaging Retention: You must retain all original packaging materials. Disposal or destruction of the shipping crate or packing materials prior to written claim resolution will completely void your eligibility for a remedy.

5. Exclusions from Claims

Phire Gigno Limited accepts no liability for damage resulting from:

  • Improper handling, unpacking, or mounting after delivery.

  • Contact with skin oils on unframed works on paper.

  • Environmental exposure (including, but not limited to, extreme humidity, temperature fluctuations, or direct UV light).

  • Third-party framing, alteration, or restoration.

6. Resolution Framework

Where a claim is verified and approved in writing by the studio, Phire Gigno Limited will determine the appropriate resolution (refund or partial refund).

  • Secondary Market Protection: We reserve the right to require the secure return of an original artwork via our designated fine art courier prior to issuing any refund, safeguarding the Artist's secondary market.

  • Processing: Refunds are issued strictly to the original payment method within 14 business days of the studio receiving the returned work or confirmed delivery.

7. Authorised Return Logistics

If a return is explicitly approved in writing by the studio, the following strict conditions apply:

  • The artwork must be dispatched within 7 days of return approval.

  • The artwork must be returned in its flawless original condition, enclosed in its original fine art packaging.

  • The buyer assumes all return shipping costs and must ensure the artwork is fully insured for its aggregate retail value during transit. The buyer retains liability for the work until it is safely received by our studio. We do not charge restocking fees.

Unauthorised returns sent without a prior written Return Merchandise Authorisation (RMA) from the studio will be rejected at delivery.

8. United Kingdom & European Union Consumers

For original paintings and bespoke commissions purchased online and shipped to consumers residing within the UK or European Union, please note that statutory rights of withdrawal do not apply. Because original paintings and commissioned masterworks are strictly one-of-a-kind physical investments, they cannot be reintroduced into inventory or resold as inventory, and are explicitly exempt from standard consumer cooling-off periods under applicable UK and EU consumer law.

Policy Revisions and Governing Terms

Phire Gigno Limited reserves the right to modify these policies at any time without prior notice. Any updates will be effective immediately upon posting to the Website. For any given acquisition, the active terms and conditions at the exact time of purchase shall govern that transaction. Continued use of the Website or subsequent acquisitions of artworks following any updates constitutes your explicit agreement to be bound by the revised policies for all future transactions.
